A nationally recognized business litigation, labor and employment and education law lawyer with an in-house and outside counsel background, Rodney Gregory Moore brings a unique and practical perspective to issues critical to businesses ranging from small to large companies; public and private educational institutions; and public agencies, including their leaders and governing boards. He has represented clients in courtrooms across the US, including in California, New York, Texas, Georgia and Tennessee; and conducted internal investigations of alleged wrongdoers in Illinois, California, Georgia, Maryland and Tennessee.
 

Rodney is an experienced employment lawyer who partners with employers to foster respectful, inclusive workplace environments. When organizations fall short of their core values and fall short of their core values and face litigation, he designs restorative remedies that both reinforce values and resolve disputes efficiently. Where claims lack merit, he defends his clients vigorously. Rodney has served as lead and co-counsel in federal and state courts, representing employers in employment litigation ranging from single-party cases to complex class and collective actions. His experience spans wage and hour claims under the Fair Labor Standards Act (FLSA) and state equivalents, Family and Medical Leave Act (FMLA) disputes, Americans with Disabilities Act (ADA) matters, due process claims involving unions and public employees, as well as labor and contractual arbitrations across multiple jurisdictions.

 

Beyond litigation, Rodney emphasizes prevention and strategic guidance. He conducts internal investigation into workplace misconduct, including claims of discrimination, harassment, and fraud, and regularly advises clients on compliance and litigation avoidance strategies. His practice also includes representing businesses of all sizes in contract disputes, vendor issues, restrictive covenant and trade secret matters, whistleblower claims, and constitutional litigation under statues such as 42 U.S.C 1981. At every step, Rodney counsels with an eye towards helping clients achieve results that align with their organizational values, encouraging them to be both audacious and inventive as they pursue their goals.

Prior to joining Sanders Roberts, LLP
  • Successfully compelled mandatory arbitration over two plaintiffs’ objections challenging the authenticity and enforceability of their electronically executed signatures (on the arbitration agreement). US District Court for the Northern District of Georgia.9
  • Successfully defended claim of wrongful termination/breach of contract arising out of termination of information technology professional based on a background check. Obtained summary judgment from US. District Court for the Western District of Tennessee; affirmed by US Court of Appeals for the Sixth Circuit.
  • Favorably resolved COVID-19-related lawsuit, arising out of layoff, alleging disability discrimination, failure to accommodate and retaliation under the Americans with Disabilities Act. US District Court for the Northern District of Georgia.
  • Successfully defended claim of sexual battery. Obtained voluntary dismissal on eve of trial from Tennessee Circuit Court.
  • Successfully defended claim involving serious injury arising out of the operation of an ROTC training program. Obtained defense verdict following trial in Tennessee Circuit Court.
  • Successfully defended claims brought by terminated insurance agent against a major insurance company alleging misclassification (as an independent contractor), breach of contract, Title VII discrimination and Title VII retaliation. Obtained summary judgment from US District Court for the Northern District of Georgia.
  • Successfully defended claim of breach of contract brought by insurance agent against a major insurance company arising out of the termination of agency relationship. Obtained summary judgment form the US District Court for the Northern District of Georgia; affirmed by US Court of Appeals for the 11th Circuit.
  • Successfully defended claims of discrimination and retaliation brought by a high-level technology employee who surreptitiously recorded secure workplace conversations with supervisor. Obtained summary judgment form the US District Court for the Northern District of Georgia; affirmed by US Court of Appeals for the 11th Circuit.
  • Successfully defended claims of discrimination, whistleblower and retaliation brought by a former chief financial officer. Obtained a jury verdict after trial in the US District Court for the Western District of Tennessee.
  • Successfully defended claim of retaliation based on HIV status and utilization of FMLA leave. Obtained summary judgment from the US District Court for the Northern District of Georgia. Successfully defended claim of liability based on alleged sexual assault committed by an employee. Obtained summary judgment from the US District Court for the Northern District of Georgia.
  • Successfully defended commercial class action alleging 42 US Code § 1981 discrimination in the administration of insurance claims. Obtained dismissal.
  • Successfully defended/resolved collective action overtime claim brought by an accountant claiming entitlement to overtime. Obtained decertification.
  • Successfully arbitrated labor appeal finding just cause for termination of an employee for threats of workplace violence. Obtained dismissal of employee’s subsequent federal court lawsuit in the US District Court for the Northern District of Georgia alleging violations of the National Labor Relations Act.
