The article, titled “Mediation as Condition Precedent to Binding Dispute Resolution,” addresses how contract clauses requiring mediation as a condition precedent to binding dispute resolution, if not properly drafted, can lead to delay and increased expenses. Mr. Pearman helps attorneys understand the potential options available when a party fails to comply with the mediation condition precedent and the importance of properly drafting those clauses.
